Agreement
These terms apply to the ThriveKore website and to every order placed with ThriveKore LLC (“ThriveKore”, “we”, “us”). By creating an account, using the website or placing an order, you agree to them. If you do not agree, do not use the website or place an order.
Eligibility
You must be at least 21 years old. You must buy for a research company, organization or institution, or as an individual researcher, and you must have a legitimate research purpose. You must be able to buy research compounds lawfully where you are.
Accounts
You may browse the catalog without an account, but you must register and sign in to place an order. Registration asks for your full name, email address, a password, your research company or organization name and an account type: Individual, Business or Institution. A Business or Institution account may add an EIN.
When you register, you confirm that you are at least 21, agree to these terms, and acknowledge that you represent a legitimate research purpose and that all products are strictly for laboratory research, not for human or veterinary use.
You agree to give accurate information and to keep it up to date. You are responsible for keeping your password secure and for all activity under your account. Do not share your account, and do not try to get around human verification or other access controls.
Verification and documentation
We may ask you to verify your account or to provide documentation of your research purpose, before or after an order. Requests come from compliance@thrivekore.com, and documents go to the same address. We may hold an order until verification is complete.
Declined and closed accounts
We may decline a registration, suspend or close an account, or cancel an order at any time. Reasons include inaccurate account information, documentation that is not provided when asked, and any sign that a product may be used outside laboratory research. If we cancel an order that has been paid, we refund the amount paid to the original payment method.
Research use only
Every product is sold for laboratory research use only. Products are not for human or veterinary use. You must not use a product, or let anyone else use it:
- in or on humans or animals, in any form
- in or as a food, drug, cosmetic or dietary supplement, or in making one
- for any clinical or diagnostic purpose
You must not resell a product for any of these uses. The Research Use Only policy forms part of these terms.
Handling and compliance with laws
You are responsible for receiving, storing, handling and disposing of every product safely, under standard laboratory practice. You are responsible for complying with all federal, state and local laws and regulations that apply to buying, holding and using the products.
Orders and pricing
There is no guest checkout. Every order belongs to a registered account. Every order is subject to acceptance, and we may decline or cancel an order because of availability, an error in price or product information, or suspected fraud.
Prices are in U.S. dollars and may change without notice. The price that applies is the one shown at checkout when you place the order. Products are offered while available. Payment is due in full when the order is placed.
Shipping and returns
We ship to addresses in the United States only. Risk of loss and title pass to you when we hand the order to the carrier. The Shipping policy and the Returns policy form part of these terms.
Product information and COAs
Product pages describe what each compound is: its name, strength, form and identifiers such as the CAS number and molecular formula. This information identifies the product. It is not a recommendation of any use.
Where a COA (certificate of analysis) is available, it is shown under the product for that exact strength and lot. COA results are reported by the testing laboratory, and we do not alter them. A COA applies only to the strength and lot it names.
No warranties
The website and the products are provided as is. To the fullest extent the law allows, ThriveKore LLC disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose. We give no warranty beyond what the law requires.
Limitation of liability
To the fullest extent the law allows, ThriveKore LLC and its members, managers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising from the website or the products.
Our total liability for any claim related to an order is limited to the amount you paid for the product that gave rise to the claim. This limit applies under any theory of liability, including contract, tort, negligence and strict liability.
Indemnification
You agree to indemnify, defend and hold harmless ThriveKore LLC and its members, managers, employees and agents against all claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys’ fees, that arise from your use or handling of the products, your breach of these terms, or your violation of any law or regulation.
Intellectual property
The content of this website, including text, images, logos and design, belongs to ThriveKore LLC or its licensors. You may not copy, reproduce or modify it without our written permission.
Governing law and venue
These terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law rules. Subject to the dispute resolution terms below, any legal action arising from these terms, the website or an order must be brought only in the state or federal courts located in Oklahoma.
Dispute resolution
Both parties will first try to settle any dispute through good-faith negotiation. If a dispute is not settled within 30 days, either party may submit it to binding arbitration under the rules of the American Arbitration Association. The arbitrator’s decision is final and binding. Disputes are resolved individually, not as a class action.
Changes to these terms
We may change these terms. A change takes effect when it is posted on this page with a new date. Using the website or placing an order after a change means you accept the revised terms.
